TERMS AND CONDITIONS FOR THE USE OF FIT HUB SERVICES

THESE TERMS AND CONDITIONS FOR THE USE OF FIT HUB SERVICES ARE ESTABLISHED FOR ANY INDIVIDUAL UTILIZING OUR SERVICES, INCLUDING BUT NOT LIMITED TO USERS OF ONE DAY PASS SERVICES, FREE TRIALS, CORPORATE MEMBERSHIPS, REGULAR MEMBERSHIPS, OR ANY RELATED PROGRAMS THAT REQUIRE YOUR PRESENCE WITHIN FIT HUB CLUB FACILITIES. THESE TERMS AND CONDITIONS CONTAIN IMPORTANT INFORMATION REGARDING YOUR RIGHTS AND OBLIGATIONS AS WELL AS THOSE OF FIT HUB. PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY.

PT Jaya Digital Properti is a company established under the laws of the Republic of Indonesia, owning and operating fitness centers under the FIT HUB trademark throughout Indonesia ("Us" or "FIT HUB"). The use of any services, including but not limited to via the website at www.fithub.id and the FIT HUB mobile application available on Android and iOS platforms, enables Us to collect, store, and process Your personal data as a user ("You") in connection with the offering, purchase, and use of the Services. These Terms and Conditions for the Use of FIT HUB Services ("Terms and Conditions" or "Agreement") are established as a written agreement to govern the rights and obligations between You and Us, which You consent to when registering and creating Your user account and/or when using the Services. By continuing to use the Services and/or by accessing Our website and mobile application, You acknowledge and agree to be bound by and comply with these Terms and Conditions. If You do not agree with these Terms and Conditions, please immediately discontinue the use of the Services and cease accessing FIT HUB's website and application.

THESE TERMS AND CONDITIONS GOVERN THE FOLLOWING MATTERS, INCLUDING BUT NOT LIMITED TO:

  1. Provisions regarding membership, Free Trial and One Day Visit services, and Single-Club Membership;
  2. Provisions regarding the requirements, methods, and procedures to take membership leave/suspension and to transfer membership;
  3. Provisions regarding Personal Training services;
  4. Provisions regarding classes;
  5. Prohibitions, warranties, and limitations of liability; and
  6. Other related matters.

  1. DEFINITIONS

    1. "FIT HUB" shall mean the trademark, business unit, or club, all of which are owned by PT Jaya Digital Properti;
    2. "FIT HUB GO" shall mean the trademark, business unit, or club owned by PT Jaya Digital Properti which provides facilities that differ from FIT HUB clubs and offers a distinct membership type from regular FIT HUB clubs;
    3. "FIT HUB Application" shall refer to the website at www.fithub.id and/or the software application based on Android and iOS, created, operated, and provided by PT Jaya Digital Properti for purposes including but not limited to membership transactions, member operational processes when entering Our Club premises, and other activities related to the fulfillment and use of the Services as well as actions relevant to the operation of FIT HUB;
    4. "Services" means any and all activities related to the use of and access to the Gym, FIT HUB Clubs, FIT HUB GO, and Classes owned by Us, whether in the form of membership or non-membership (such as free trial, one day pass, etc.), including but not limited to the use of equipment, facilities, programs, and other associated matters;
    5. "Club" refers to each business unit owned by FIT HUB located within the territory of the Republic of Indonesia;
    6. "User" means You as a user of the Services, whether registered as a member or otherwise accessing through non-membership schemes (such as free trial, one day pass, and any other form);
    7. "Member" means You as a User who has purchased or holds a membership with FIT HUB;
    8. "Membership" refers to the membership that You are required to possess prior to using Our Services, except in the case of free trial, one day pass, and other non-membership access types;
    9. "Reformer Pilates Membership" refers to the membership required for You to access Our Reformer Pilates Class Services;
    10. "All Club Access Membership" shall mean a type of Membership that grants You access to use the Services at all FIT HUB Clubs;
    11. "Single Club Access Membership" shall mean a type of Membership that grants You exclusive access to use the Services at one specific Club only, and does not permit You to access any other FIT HUB Clubs apart from the Club where You are registered as a Member. Accordingly, You may only perform check-in at the Club designated in Your Membership;
    12. "Personal Trainer" means an individual who is authorized to coach, guide, and provide advice to You during Your use of the Services;
    13. "Gym" means the premises provided by Us for conducting exercise and training activities;
    14. "Class" means a guided workout session led by an instructor provided by Us;
    15. "Operating Hours" means the opening and closing hours of the Club;
    16. "Home Club" means the primary Club location selected by You or as stated within the FIT HUB Application;
    17. "PAR-Q" or Physical Readiness Activity Questionnaire means a readiness assessment form designed to help You determine Your ability to undertake physical activities and/or an exercise program appropriate for Your condition;
    18. "Medical Release Form" means the official document provided by Us to be completed and signed by an authorized health professional to assess Your health condition. This form will determine Your eligibility to participate in a training program (Personal Trainer) and to perform certain physical activities.
  2. USE OF THE APPLICATION

    1. To access and use Our Services, You are required to have the FIT HUB application, which functions to facilitate check-in, book Classes, and enter Our Club premises.
    2. The account You use in the FIT HUB Application must be registered under Your own name and personal information, and You are not permitted to transfer or allow the use of Your account by any other party for any reason, unless expressly authorized by Us.
    3. By continuing to use the Services, You acknowledge and agree to be bound by all provisions set forth in the FIT HUB Application Terms of Use and the FIT HUB Privacy Policy.
  3. AGE REQUIREMENTS

    1. The minimum age to obtain Membership and access the Services is 12 (twelve) years old.
    2. For Users aged under 17 (seventeen) years old, the use of FIT HUB Services and facilities is permitted under the following terms and conditions:
      1. You must obtain written consent from Your legal guardian, which must be submitted during the Membership registration process;
      2. You must provide additional documents beyond the list of personal information, namely:
        1. Completion and signing of the Consent Statement Form provided by Us; and
        2. Submission of supporting documentation in the form of a Family Card (Kartu Keluarga).
    3. For Users aged under 15 (fifteen) years old, the use of FIT HUB Services and facilities is permitted under the following additional terms and conditions:
      1. You must obtain written consent from Your legal guardian, which must be submitted during the Membership registration process;
      2. You must provide additional documents beyond the list of personal information, namely:
        1. Completion and signing of the Consent Statement Form provided by Us; and
        2. Submission of supporting documentation in the form of a Family Card (Kartu Keluarga);
      3. You are required to use Personal Trainer services, wherein the number of Personal Trainer sessions will be adjusted based on Your Membership duration.
    4. Children under the age of 12 (twelve) are not permitted to enter Club areas (including the Gym floor and studio), even as companions.
  4. PAYMENT

    1. The use of certain FIT HUB Services may require You to make payments, such as Membership fees or additional charges for specific Services, including but not limited to Classes, Personal Trainer sessions, use of equipment and facilities, products sold within Our Club premises, and other services made available to You.
    2. You are responsible for paying all fees incurred in connection with Your use of the Services as stipulated in these Terms and Conditions.
    3. If payment is made via bank transfer, it must be made solely to the official bank account and/or virtual account designated by Us. You are strongly advised not to make payment to any account other than the official bank account or virtual account of PT Jaya Digital Properti, including but not limited to payments made to personal accounts of employees, individuals claiming association with Us, or any other accounts not registered under the name of PT Jaya Digital Properti. You are obligated to verify the correctness of the payment account information, and any losses arising from payment made to accounts other than Our official accounts shall be entirely Your responsibility. By doing so, You hereby waive any claims or liabilities of any kind against Us in relation to such losses.
    4. All fees referred to in this Article are included in Service Tax, Goods Tax, Value Added Tax, or any other taxes that may be applicable under prevailing laws and regulations.
    5. You understand and agree that any refund related to Services You have already used shall only be processed in accordance with FIT HUB policies, including but not limited to the procedure and amount of any such refund.
  5. MEMBERSHIP

    1. GENERAL PROVISIONS

      1. To access and use Our Services, including but not limited to Membership, free trial, one day pass, or any other related program that requires Your presence within FIT HUB Club premises, You are required to present and/or submit Your personal data, which may include:

        1. Identification (National ID Card/KTP, Driver’s License/SIM, or Passport);
        2. Phone number;
        3. Address;
        4. Email address;
        5. Personal details;
        6. Emergency contact number as required in the PAR-Q;
        7. Profile photo taken without any facial covering of any kind, including but not limited to masks, glasses, sunglasses, accessories, or hats, to ensure clear facial recognition by our system; and
        8. Any other relevant personal information as may be required.
      2. Your Membership will be deemed active as of the date on which payment is received by FIT HUB, whether purchased through the Application or offline at Our Clubs and/or through Our fitness consultants, unless otherwise stipulated in accordance with FIT HUB policy.

      3. To access and use Our Services, including but not limited to Membership, free trial, one day pass, or any related programs that require Your presence within FIT HUB Club premises, You are required to complete and agree to the PAR-Q and, if necessary, to also complete and submit the Medical Release Form based on the information provided in the PAR-Q.

      4. You understand and agree that the completion of the PAR-Q is a mandatory requirement prior to participating in any physical activity at FIT HUB Clubs, in order to ensure Your safety and comfort while exercising. Your failure to fulfill this obligation shall be deemed as Your express agreement to waive any claims or compensation against FIT HUB for any incident arising in connection with the obligations of the PAR-Q.

      5. During Your use of Our Services, including but not limited to Membership or any related programs requiring Your presence within FIT HUB Club premises, whether with or without a Personal Trainer, You are obligated to promptly inform Us of any changes in Your health condition, including but not limited to pregnancy, injury, heart conditions, respiratory issues, or any other medical condition that may affect Your training program. In the event of such changes, You must update Your PAR-Q and, if necessary, submit an updated Medical Release Form reflecting Your current condition before continuing training sessions and/or using the Services.

      6. If You fail to provide information related to changes in Your health condition and/or fail to submit the required PAR-Q and/or Medical Release Form as referred to in point (iv) above, You hereby agree to accept and assume all risks and consequences arising from Your participation in the use of the Services. In such event, You declare and warrant to indemnify and hold FIT HUB harmless from any form of claims, demands, or liabilities of any kind that may arise in the future.

      7. When checking in at a FIT HUB Club after completing the process referred to in point (i) above, You are required to comply with the following procedures:

        1. You must present the QR code found in Your FIT HUB application. The QR code must not be in the form of a screenshot or printed copy and may only be accessed directly through the FIT HUB application;
        2. You are not permitted to lend Your application account or FIT HUB Membership to any third party in any form, including by sharing a screenshot of the QR code;
        3. You are not permitted to wear any facial coverings such as masks, helmets, hats, sunglasses, or accessories that may hinder facial identification during the check-in process; and
        4. If You fail to meet the above check-in requirements, You will not be allowed to access FIT HUB Services and facilities until all conditions are fulfilled in accordance with these Terms and Conditions.
      8. FIT HUB offers the following types of Membership:

        1. All Club Access Membership: grants You access to use FIT HUB Services at all FIT HUB Clubs, and You are required to comply with all provisions of these Terms and Conditions;
        2. Single Club Access Membership: grants You access to use FIT HUB Services at one designated FIT HUB Club only, where certain Services may not be available, as further regulated under point (b) below regarding Single Club Access Membership;
        3. FIT HUB GO Membership: is a separate membership from FIT HUB that grants You access limited to FIT HUB GO Clubs only, and You are required to comply with all provisions as further stipulated in point 5(d) regarding FIT HUB GO Membership; and
        4. Reformer Pilates Class Membership: grants You access to Reformer Pilates Class Services, and You are required to comply with all provisions as further regulated in point 5(e) regarding Reformer Pilates Class Membership.
      9. You understand and agree that the legal relationship arising from Your Membership under these Terms and Conditions is a contractual relationship between You and Us as a legal entity, and not with any specific FIT HUB Club.

      10. You are required to safeguard Your belongings, particularly valuable items such as jewelry, communication devices, electronic equipment, and personal vehicles. You understand and agree that FIT HUB shall not be liable for any form of loss and/or damage to personal belongings, whether occurring inside the Club premises or in the surrounding areas. Accordingly, We strongly advise You not to leave valuable items in the changing rooms or in Your personal vehicle parked in the parking area or any other area surrounding FIT HUB.

      11. In the event that any of Our Clubs ceases operations for any reason, and such Club is the Club where You are registered as a Member or designated as Your Home Club, Your Membership or Home Club shall automatically be transferred to another FIT HUB Club closest to Your location, without any compensation.

    2. SINGLE CLUB ACCESS MEMBERSHIP

      1. If You are a Member with a Single Club Access Membership, then:
        1. You may only use the Services and book Classes for sessions held at the Club listed under Your Membership;
        2. You may only purchase products and Personal Trainer Services available at the Club listed under Your Membership;
        3. You are not permitted to change Your Membership to an all-club-access Membership or transfer Your Membership to another FIT HUB Club before Your current Single Club Access Membership expires; and
        4. You are not allowed to take a membership leave or transfer Your Membership during the validity period of Your Single Club Access Membership.
      2. Except as regulated in point (i) above, all provisions contained in these Terms and Conditions apply equally to You as a Single Club Access Membership holder, and You are required to comply with these Terms and Conditions in relation to Your use of Your FIT HUB membership.
      3. FIT HUB has the full and absolute right to extend and/or discontinue the Single Club Access Membership program at any FIT HUB Club, which may have the following impact on Your Membership:
        1. If the FIT HUB Club where You are registered as a Single Club Access Member is declared closed for any reason based on FIT HUB's decision where FIT HUB is not obligated to disclose the reason to You, Your Single Club Access Membership will be transferred to the nearest FIT HUB Club;
        2. If FIT HUB decides to discontinue the Single Club Access Membership, whether for Your Home Club or for all FIT HUB Clubs, You will still be allowed to use Your current Single Club Access Membership until it expires. However, You will not be able to extend or repurchase the same type of Membership. If You wish to continue using FIT HUB Services, You may purchase another available Membership type.
    3. ALL CLUB ACCESS MEMBERSHIP

      If You have an active Membership that includes access to all Clubs (All Club Access Membership), You are not permitted to change Your Membership to a Single Club Access Membership before the validity period of Your all-club-access Membership ends.

    4. FIT HUB GO MEMBERSHIP

      1. FIT HUB GO Membership is a Membership program that allows You to use Services limited to all FIT HUB GO Clubs; however, You may not use Services at FIT HUB Clubs.

      2. If You are a Member with a FIT HUB GO Membership, then:

        1. You may only book Classes held at FIT HUB GO;
        2. You may only purchase products and Personal Training Services available at FIT HUB GO; and
        3. You are not permitted to change Your Membership to an all-club-access Membership or transfer Your Membership to other FIT HUB Clubs before the validity period of Your FIT HUB GO Membership ends.
      3. If You have an active Membership that includes access to all Clubs (All Club Access Membership) or a Single Club Access Membership, You are not permitted to change Your Membership to a FIT HUB GO Membership before Your current Membership’s validity period ends.

      4. Except as provided in point (ii) above, all provisions contained in these Terms and Conditions apply equally to You as a FIT HUB GO Membership holder, and You are required to comply with these Terms and Conditions in relation to Your use of Your FIT HUB Membership.

      5. FIT HUB has the full and absolute right to extend and/or discontinue the FIT HUB GO Membership program at any FIT HUB Club, which may affect Your Membership as follow:

        1. In the event that the FIT HUB GO Club serving as the basis of your FIT HUB GO Membership is declared closed for any reason, whereby FIT HUB is not obligated to disclose the reason to you, your FIT HUB GO Membership will be transferred to another FIT HUB Club in accordance with our policy, or a refund policy will apply, subject to the provisions set forth in point 4(e) above.
        2. If FIT HUB decides to discontinue the FIT HUB GO Membership program, whether only for Your Home Club or for all FIT HUB Clubs, You may continue to use Your FIT HUB GO Membership until it expires while still adhering to all provisions in this section, but You will not be allowed to repurchase the same Membership. If You wish to continue using FIT HUB Services, You may purchase a Membership that includes access to all FIT HUB Clubs.
      6. If You insist on using Your Membership at a Club not included under the FIT HUB GO Membership program, FIT HUB has the absolute right to terminate Your Membership, with due regard to the provisions under point 4(e) above.

    5. REFORMER PILATES CLASS MEMBERSHIP

      1. Reformer Pilates Class Membership is an additional program that allows You to participate in Reformer Pilates Classes available at designated FIT HUB Clubs. This Reformer Pilates Class Membership can only be obtained if You already have an All Club Access Membership.
      2. You are required to wear specific Reformer Pilates equipment during classes, including but not limited to appropriate socks and suitable clothing throughout the session.
      3. If You hold a Reformer Pilates Class Membership, then:
        1. If You wish to participate in a Reformer Pilates Class, You may book Reformer Pilates Classes only through the FIT HUB Application;
        2. You may only book Reformer Pilates Classes as long as Your Reformer Pilates Membership is still active;
        3. Reformer Pilates Class bookings are limited to a maximum of 2 (two) times per day. This rule also applies if You book other Classes outside of Reformer Pilates Classes, meaning the total allowed number of Class bookings per day remains capped at 2 Classes.
        4. If You have booked a Reformer Pilates Class but cancel the class less than 2 (two) hours before class time for 2 (two) consecutive occurrences, You will automatically be placed on the blacklist for a period of 1 (one) week and will not be able to book Reformer Pilates Classes;
        5. If You have booked a Reformer Pilates Class but do not attend the class, You will automatically be placed on the blacklist for a period of 1 (one) week and will not be able to book Reformer Pilates Classes;
        6. If You do not secure a slot when booking a Reformer Pilates Class, You have the opportunity to join the waitlist through the FIT HUB Application;
        7. The waitlist capacity is 25% (twenty-five percent) of the total class capacity for Reformer Pilates;
        8. If You are on the waitlist:
          1. If You receive a class slot, You will be notified and will have 10 (ten) minutes to confirm Your attendance through our application;
          2. If You decline or fail to confirm Your attendance, the class slot will be offered to the next Member on the waitlist; and
          3. You may enter the waitlist for only 1 Class at 1 (one) Club at any given time.
        9. If You are on the waitlist, You are not permitted to:
          1. Enter the waitlist for another Class at the same time; and
          2. Enter the waitlist for another Class at a different Club.
        10. You are allowed to request Reformer Pilates Membership Freeze subject to the conditions further regulated in these Terms and Conditions;
        11. You may not transfer Your Reformer Pilates Class Membership during its active period, even if You transfer Your general Membership.
    6. MEMBERSHIP FREEZE

      1. You may request a Membership Freeze, during which we will temporarily deactivate Your account for the period You choose in accordance with these Terms and Conditions.
      2. The conditions for Membership Freeze as stated in this section are: a minimum of 1 (one) request for a duration of 1 (one) month, and a maximum of 2 (two) requests, each with a duration of 1 (one) month per Membership Freeze period.
      3. If You are in a Membership Freeze period, Your Personal Trainer program and Your Reformer Pilates Class Membership (if any) will also be automatically frozen, and You will not be able to use any of our Services, including Personal Trainer sessions or Reformer Pilates Classes.
      4. Membership Freeze as described in these Terms and Conditions is subject to a fee of Rp.89,000,- (eighty-nine thousand Rupiah) per month.
      5. If You wish to apply for a Membership Freeze period longer than the above limit, You must provide additional supporting documents, such as:
        1. Doctor’s note regarding Your medical condition;
        2. Official work assignment letter;
        3. Medical certificate confirming pregnancy;
        4. Other reasons that prevent a member from performing physical activities for an extended period.
    7. TRANSFER MEMBERSHIP

      1. You may conduct a Membership Transfer, whereby we will transfer Your Membership to another party of Your choosing, subject to the terms and conditions set forth in this section.
      2. Membership Transfer can only be performed if Your Membership has a remaining active period of at least 30 (thirty) days.
      3. Membership Transfer includes any Personal Trainer package You have, meaning any remaining Personal Trainer sessions will also be transferred to the recipient.
      4. Membership Transfer does not include the transfer of Reformer Pilates Class Membership; therefore, if You transfer Your Membership, any Reformer Pilates Class Membership You hold will not be transferred to the recipient.
      5. The individual receiving the Membership Transfer must meet the following requirements:
        1. Fulfill all requirements stated in these Terms and Conditions as well as the FIT HUB Application Terms of Use;
        2. Not have any active Membership at FIT HUB;
      6. You may transfer Your Membership to a person who has previously been a Member at FIT HUB, provided that the individual has passed the grace period of 30 (thirty) days after their previous Membership expired.
      7. Membership Transfer as described in these Terms and Conditions is subject to a fee of Rp.50.000,- (fifty thousand Rupiah) per 30 (thirty) days of remaining Membership being transferred.
      8. You must come to Your Home Club and complete the Membership Transfer form provided by us to initiate the process.
      9. The recipient of the Membership Transfer must sign the Gym Membership Agreement, activate the Membership through the FIT HUB application, and complete the Membership Transfer payment as specified in point (vi) above using the payment methods provided by us.
      10. Membership Transfer will transfer the entire remaining active Membership; therefore, partial transfer of Membership is not permitted for any reason. Furthermore, once the transfer is completed, Your account will be immediately deactivated by FIT HUB and transferred to the recipient’s account.
      11. You may not set or impose any price other than the official fee stated in point (vi) above for the Membership Transfer. Any violation of this rule will result in sanctions as outlined in these Terms and Conditions.
      12. If FIT HUB discovers any violations related to the Membership Transfer process as regulated in these Terms and Conditions, FIT HUB reserves the full and absolute right to terminate Your Membership as well as the Membership of the third-party recipient without compensation or refund of any kind.
  6. PERSONAL TRAINING SERVICES

    1. You understand that Personal Training is a program in which You will undergo training at our Gym using the services of a Personal Trainer provided by us, with payment separate from Your Membership fees. For further details on class sessions and pricing, You may refer to our website or the FIT HUB Application.
    2. To participate in the Personal Training program, You are required to complete and submit the Medical Release Form, which must align with the information provided in Your PAR-Q.
    3. If Your Personal Training validity period ends while You still have remaining training session quotas, those remaining sessions will be considered forfeited and cannot be used.
    4. You may schedule Personal Training sessions through our staff.
    5. In relation to point (d) above, You may reschedule Your Personal Training session no later than 24 hours before the scheduled session begins.
    6. If You do not attend a scheduled Personal Training session without rescheduling beforehand, the session will be considered used and will be deducted from Your Personal Training quota.
    7. If desired, You have the right to request a change of Your Personal Trainer. However, the appointment of a replacement Personal Trainer is entirely under FIT HUB’s authority and cannot be contested.
    8. FIT HUB holds full authority to replace Your Personal Trainer for any reason. This decision is final and cannot be disputed.
    9. You are not permitted to:
      1. Transfer Your Personal Training program to another party, except under conditions permitted as stated in these Terms and Conditions;
      2. Cancel or modify the session schedule directly with the Personal Trainer or outside the procedures set forth in these Terms and Conditions;
      3. Request a refund for any sessions already paid for and completed, except as specified in point 4(e) above;
      4. Conduct Personal Training sessions outside the Club area, including offering Personal Trainers to conduct private sessions outside the Club or at another gym;
      5. Invite, accept, or request Personal Trainers to sell or purchase Personal Training programs or any related programs other than those offered by FIT HUB;
      6. Bring an external Personal Trainer not provided by FIT HUB for any reason; and
      7. Conduct training sessions with any Personal Trainer not registered with FIT HUB, including in cases where the individual holds a FIT HUB membership.
  7. CLASSES

    1. BOOKING CLASS
      1. If You wish to join a Class provided at FIT HUB, You may book the Class only through the FIT HUB Application;
      2. You may only book Classes as long as You have an active Membership;
      3. Class bookings are limited to a maximum of 2 (two) times per day;
      4. Class bookings may be made 24 (twenty-four) hours before the Class begins;
      5. If You book more than one Class, You may not book 2 Classes scheduled close to each other at different Clubs;
      6. Booked Class will be automatically forfeited if You arrive more than 15 minutes late;
      7. You understand that Classes may be canceled at any time, which may result in the Class not being conducted. In such cases, Your booking for that Class will be automatically forfeited.
    2. CANCEL CLASS
      1. If You have booked a Class but cancel it less than 2 (two) hours before the Class begins for 2 (two) consecutive occurrences, You will automatically be placed on the blacklist for a period of 1 (one) week and You will not be able to book Classes;
      2. If You have booked a Class but do not attend the Class, You will automatically be placed on the blacklist for a period of 1 (one) week and You will not be able to book Classes;
    3. WAITLIST
      1. If You do not obtain a slot when booking a Class, You have the opportunity to enter the waitlist through the FIT HUB Application;
      2. The waitlist capacity is 25% (twenty-five percent) of the total Class capacity;
      3. If You are on the waitlist:
        1. If You receive a slot, You will be notified through the FIT HUB Application and will have 10 (ten) minutes to confirm Your attendance;
        2. If You decline or fail to confirm Your attendance, the slot will be given to the next Member on the waitlist; and
        3. You may only enter the waitlist for 1 Class at 1 (one) Club at a time.
      4. If You are on the waitlist, You are not allowed to:
        1. Enter the waitlist for another Class at the same time; and
        2. Enter the waitlist for another Class at a different Club.
  8. FREE TRIAL AND ONE DAY VISIT SERVICES
    To help You experience FIT HUB Services directly at available Club locations, FIT HUB provides free trial and one day visit services, under the following terms:

    1. FREE TRIAL:
      1. The Free Trial Service provides You with a one-time opportunity to try FIT HUB facilities for free within a specified usage period;
      2. You may access the Free Trial Service by visiting one of our Clubs and registering through the FIT HUB Application or directly with one of our fitness consultants (FC);
      3. The age requirements for using the Free Trial Service follow the conditions outlined in point 3 of these Terms and Conditions;
      4. You will receive a barcode to check in at our Club and access the facilities available specifically for Free Trial users, which include Gym floor access and Classes, but do not include Personal Training Services or Reformer Pilates Class Services;
      5. The Free Trial usage is valid only at the Club where You registered;
      6. The Free Trial usage period ranges from a minimum of 3 (three) days to a maximum of 7 (seven) days and cannot be extended. You will receive information about the validity period through the FIT HUB Application;
      7. Once the Free Trial period ends, You cannot extend it and are not required to register for a Membership. However, if You wish to continue using FIT HUB Services, You must register for a Membership and may not use the Free Trial Service again;
      8. The Free Trial period remains subject to all applicable Service Usage Terms outlined in these Terms and Conditions;
      9. Any violation of these Free Trial conditions will be subject to sanctions as specified in these Terms and Conditions; and
      10. You understand and agree that FIT HUB has full authority to approve or reject Your use of the Free Trial Service at its sole discretion.
    2. ONE DAY VISIT:
      1. The One Day Visit Service provides You with a one-time opportunity to try FIT HUB facilities for 1 (one) day and cannot be extended or repurchased;

      2. You may access the One Day Visit Service by visiting our Club directly, submitting Your identification card (KTP/SIM) for safekeeping, and making a payment of Rp150.000,- (one hundred fifty thousand Rupiah) through the payment methods specified in these Terms and Conditions;

      3. Your identification card will be held by Customer Service for the purpose of providing You with a locker key; and

      4. You may use the One Day Visit Service after completing payment and submitting Your identification card;

      5. The facilities available under One Day Visit include access to the Gym floor only, excluding Classes, Personal Training Services, and Reformer Pilates Class Services; and

      6. Any violation of these One Day Visit conditions will be subject to sanctions in accordance with these Terms and Conditions.

      7. You understand and agree that FIT HUB has full authority to approve and/or reject Your use of the One Day Visit Service at its sole discretion.

  9. PROHIBITIONS
    For the safety and comfort of all, You are prohibited from engaging in the following actions, including but not limited to:

    1. Disposing of trash improperly or not in the designated waste bins;

    2. Taking any form of photos or videos in any area, including the Gym floor, toilets, changing rooms, or Classes—including but not limited to photos or videos showing the face, identity, or body parts of other Members or FIT HUB staff—without their consent, for any purpose whether commercial or non-commercial;

    3. Using equipment, tools, or facilities in a way that may or has the potential to disturb, obstruct, or harm the activities of other Members;

    4. Selling, transferring, or handing over Membership and/or Personal Training sessions in any form to another party outside the procedures specified in these Terms and Conditions;

    5. Allowing, enabling, or giving access to others to use the facilities by using Your Membership, including but not limited to account sharing or Membership sharing practices;

    6. Engaging in violence toward fellow Members or FIT HUB staff, including but not limited to physical actions such as hitting, pushing, or any act that causes injury or pain, as well as non-physical actions such as threats, intimidation, or behavior that creates fear or a sense of insecurity;

    7. Engaging in any form of harassment toward other Members or FIT HUB staff, including but not limited to physical sexual harassment such as touching, gestures, or actions with sexual intent without consent, as well as verbal sexual harassment such as inappropriate speech, comments, jokes, or gestures that demean or disrespect others.

    8. Creating disturbances of any kind that disrupt FIT HUB's operations, either directly within the Club area or indirectly through social media or other communication channels;

    9. Offering or performing any fitness-related services resembling Personal Trainer services to other Members, including but not limited to providing workout instructions, paid assistance, or using facilities for Your personal commercial purposes;

    10. Selling, offering, or promoting any goods and/or services within the Club area without written permission from FIT HUB, including but not limited to fitness-related products such as supplements, health drinks, sports apparel, or equipment, as well as non-fitness items such as food, beverages, electronics, and others;

    11. Bringing children under 12 (twelve) years old into the Club area, including but not limited to the Gym floor and Class rooms;

    12. Bringing food and/or eating within the Club area;

    13. Wearing indecent clothing and/or clothing that does not cover the chest area while inside the Club;

    14. Wearing footwear other than proper sports shoes, including but not limited to sandals, slides, thick socks, or being barefoot during workouts on the Gym floor;

    15. Using equipment, facilities, or parts of the Club building (including but not limited to toilets, walls, mirrors, and other supporting structures) in a manner inconsistent with usage guidelines or in a way that may cause damage. If any equipment, facility, or building structure is damaged due to Your actions or negligence, You are responsible for paying repair costs and/or compensation;

    16. Engaging in activities within the Club while under the influence of alcohol and/or in a state of intoxication;

    17. Disparaging or defaming the name of FIT HUB in any form and failing to communicate complaints first through the official channels provided by us. You understand that this constitutes a violation, and we reserve the right to take action, including legal action, in accordance with applicable Indonesian law;

    18. Committing criminal acts of any kind within the Club area, including but not limited to theft and embezzlement, offering, selling, or misusing narcotics, fraud, forgery, assault, or any other criminal acts as regulated by applicable law.

  10. LOCKER USE
    You hereby acknowledge, declare, and warrant that during Your workout, You are entitled to use the daily locker to store Your belongings, under the following conditions:

    1. You understand and agree that FIT HUB will not charge any fee for the use of the locker, and therefore any loss of items stored in the locker is not the responsibility of FIT HUB, and You will not make any claims against FIT HUB regarding such loss.
    2. You may request a locker key from our Customer Service (CS) team and must return the key to CS after completing Your workout on the same day;
    3. If You take the locker key home with You, You must return the locker key and pay a fine of Rp.10.000,- (ten thousand Rupiah) per day;
    4. If the locker key is lost, You will be charged a fine of Rp.75.000,- (seventy-five thousand Rupiah);
    5. Lockers must be emptied after You finish Your workout on the same day;
    6. All lockers will be checked and emptied at the end of each operational hour;
    7. If there are items left in the Club area, we reserve the right to take necessary actions regarding the left items, such as storing them in the lost and found area, and/or disposing of them without prior notification to You, under the following conditions:
      1. Consumable and perishable items will be immediately disposed of at the end of the day; and
      2. Other types of items will be stored for 3×24 hours before being disposed of by us.
  11. CLUB OPERATING HOURS
    The Club's operating hours will follow what is displayed at the Club entrance or on the notice boards within the Club area. We reserve the right to adjust the Club's operating hours for any purpose, including but not limited to cleaning, decoration, maintenance, and/or holidays. We may provide notice of such changes in operating hours by any means deemed appropriate according to FIT HUB's policy.

  12. STATEMENTS AND WARRANTIES

    1. You hereby agree to be fully responsible for all liabilities and losses incurred by Yourself or other Members as a result of any violation of these Terms and Conditions, or from any accident—including but not limited to physical injury, mental injury, economic loss, or any loss suffered by other visitors—caused by Your intentional actions or negligence in using FIT HUB services (and vice versa). If any claims arise from any party due to injury, loss, or other damages related to You or other Members caused by Your actions, You agree to:

      1. defend FIT HUB against all such claims and reimburse FIT HUB for all expenses, including legal fees, arising from such claims;
      2. protect FIT HUB from any liability to You, Your spouse, Your unborn child, family members, or anyone else as a result of such claims; and
      3. release FIT HUB from all forms of claims, lawsuits, and compensation of any kind and from anyone without exception.
    2. By completing and agreeing to the PAR-Q and/or Medical Release Form, You acknowledge that all information You provide is true, complete, and reflective of Your current health condition. You consciously understand and accept all risks that may arise from participating in physical activities within FIT HUB. If at any time health issues, injuries, or other medical conditions arise due to or related to undisclosed conditions or inaccurate information provided in the PAR-Q and/or Medical Release Form, such matters fall entirely outside FIT HUB's responsibility. You hereby release FIT HUB, including all affiliates and personnel, from any form of claims, demands, or legal liabilities arising from such matters.

    3. You further acknowledge that FIT HUB never promises anything beyond what is officially stated in writing through FIT HUB's website, FIT HUB Application, or FIT HUB's official social media channels, as well as what is written in these Terms and Conditions. If You receive any promises outside of these Terms and Conditions—for example, from FIT HUB staff (individual misconduct)—You may report it to FIT HUB, but such promises are not valid or binding for either party. You hereby release FIT HUB from all forms of claims, lawsuits, and compensation of any kind and from anyone without exception.

  13. TERMINATION AND CANCELLATION

    1. Termination refers to the permanent ending of a Membership, either initiated by FIT HUB due to a violation committed by the Member according to the rules and policies stated in these Terms and Conditions. Termination by FIT HUB may occur if there is a breach of the Terms and Conditions, actions that harm FIT HUB or other Members, or based on FIT HUB's assessment and policies. Once the Membership is terminated, the Member's access rights to use the Services and all FIT HUB Gym facilities will be revoked, and You understand and agree that Membership fees or other payments already made are generally non-refundable, except as stated in point 4(e) above.
    2. Cancellation refers to a condition in which a Membership registration that has just been submitted is declared invalid before the Membership period begins. Cancellation may be carried out by FIT HUB for administrative reasons, including but not limited to incomplete required documents, failure to complete payment, or discrepancies in the submitted data.
    3. Based on these Terms and Conditions, we reserve the right to:
      1. issue warnings in the form of written or verbal notices and/or Membership termination letters, which may be sent via the email registered in Your FIT HUB Application and/or Your phone number, or through any other method deemed appropriate by FIT HUB;
      2. suspend, restrict, or terminate Your access to one or all Services;
      3. immediately deactivate Your account for any reason, including but not limited to situations where:
        1. we reasonably believe we are required to do so under applicable law, court order, or other authority in any jurisdiction;
        2. You violate any provision in these Terms and Conditions, either through a single direct violation or repeated violations following prior warnings from us.
    4. We retain full authority, at any time and at our sole discretion, to suspend, restrict, or terminate Your access to part or all of the Services, as well as to deactivate or cancel Your account. Such actions may be taken without any obligation to provide a reason, and with or without prior notice to You.
    5. You hereby acknowledge and agree that our decisions regarding suspension, restriction, or termination of accounts are entirely based on internal policies, risk management criteria, and security protocols that are confidential in nature. You further waive the right to request explanations, details, or justification of any kind regarding the policies, criteria, or procedures underlying such actions.
    6. Any consequences arising from the suspension, restriction, or termination of Your account are entirely Your responsibility and do not create any obligation for us to provide compensation in any form.
  14. CCTV ACCESSIBILITY
    We have installed Closed-Circuit Television (CCTV) in several strategic areas within the Club with the primary purpose of supporting the safety and security of all Users. However, CCTV installation does not cover private areas such as lockers, changing rooms, and bathrooms. Therefore, if incidents such as accidents, loss, or theft occur in those areas, they cannot be captured by the CCTV system.

    Accordingly, Members understand and agree to the following:

    1. CCTV recordings are managed in a restricted and confidential manner, with a specific storage duration and quality aligned with FIT HUB's internal policies.
    2. Access to CCTV recordings can only be granted to authorized authorities, specifically the Indonesian National Police, based on an official written request as supporting evidence during an investigation. Therefore, Members, visitors, and any other parties do not have the right to request, copy, or directly access CCTV recordings.
    3. You are required to independently process any official request letter for CCTV access to the Indonesian National Police. FIT HUB holds no responsibility to process or assist You in obtaining such documents.
    4. FIT HUB reserves the right to reject any CCTV access requests that are not submitted in accordance with the legal requirements and procedures described above.
  15. PARKING PROVISION
    Regarding parking regulations, Members understand and agree to the following:

    1. Members must park their vehicles only in areas designated by FIT HUB, building management, area management, or other authorized parties, and are prohibited from parking in areas that are legally restricted, potentially disruptive to others' comfort or safety, or in locations declared prohibited by FIT HUB.
    2. FIT HUB is not a parking service provider and does not manage parking operations. Therefore, all monitoring, supervision, and security of the vehicle and its contents remain the full responsibility of the vehicle owner.
    3. In the event of loss, damage, or any other incident affecting the vehicle or the items inside it—including but not limited to theft, destruction, or vandalism—FIT HUB is not responsible for any resulting losses.
    4. If parking operations are managed by a third party or building management, all terms and responsibilities related to parking are subject to the applicable terms and conditions set by such party.
  16. GOVERNING LAW
    This Agreement is governed by and construed in accordance with the laws of the Republic of Indonesia. You agree that any legal action or dispute that may arise from or in any way relate to the Services and/or this Agreement will first be resolved through amicable deliberation. If it cannot be resolved, You agree to submit to the jurisdiction of the South Jakarta District Court and/or any other District Court having authority to adjudicate legal disputes between You and FIT HUB.

  17. FORCE MAJEURE
    If a force majeure event occurs that causes any FIT HUB Club location to be unable to operate, including but not limited to natural disasters, fire, flood, earthquake, outbreaks of infectious disease, pandemics, government policies or regulations, power outages, severe damage to facilities and infrastructure, or disruptive social conditions such as riots, demonstrations, civil unrest, or other security disturbances, then FIT HUB is released from any obligation to provide access to the affected Club location for the duration of the force majeure period. Nevertheless, Members may continue to exercise their access rights at other FIT HUB Club locations within the provider's network throughout Indonesia. Accordingly, a force majeure event does not cancel or suspend a Member's membership; it only restricts access to the specific affected location.

  18. CHANGES TO THE TERMS AND CONDITIONS
    In the event of any changes or additions to these Terms and Conditions, we will notify You no later than 7 (seven) days prior to the effective date. Such notice may be provided by email, through notifications in our application, or by any other means at FIT HUB's discretion. If You object to the changes after being informed, You may cease using FIT HUB Services by deactivating Your account before the effective date; in such case, FIT HUB is not obliged to refund any payments, including unused portions, except as provided in point 4(e) above. However, if You continue to use FIT HUB Services after the aforementioned period, You will be deemed to have accepted the changes and will be subject to all updated rules and provisions.
