TERMS AND CONDITIONS FOR THE USE OF THE FIT HUB WEBSITE & APPLICATION

THESE TERMS AND CONDITIONS FOR THE USE OF THE FIT HUB WEBSITE, APPLICATION, AND SERVICES CONTAIN IMPORTANT INFORMATION REGARDING THE RIGHTS AND OBLIGATIONS OF USERS AND FIT HUB. PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY.

PT Jaya Digital Properti is a company established under the laws of Indonesia that owns and operates the application & website related to the provision of fitness center services under the FIT HUB trademark within Indonesia (“We” or “FIT HUB”). The use of any FIT HUB services through the website www.fithub.id and the FIT HUB mobile application on Android and iOS devices (“Website/Application”) allows us to collect, store, and process the personal data of users (“Users”) in connection with the offering, purchase, and use of FIT HUB services.

These Terms and Conditions for the Use of the FIT HUB Application and Website (“Terms and Conditions” or “Agreement”) serve as a written agreement governing the rights and obligations of Users and FIT HUB, which Users accept when registering and creating a User account to access the Website/Application.

By continuing to use FIT HUB services and accessing our Website/Application, Users declare their agreement to be bound by and comply with these Terms and Conditions. If Users do not agree with these Terms and Conditions, they must cease using FIT HUB services and accessing the Website/Application.

THESE TERMS AND CONDITIONS GOVERN, INCLUDING BUT NOT LIMITED TO:

1. Provisions for accessing, downloading, or using the Website/Application and FIT HUB’s services;
2. Provisions concerning the storage and use of Users’ personal information;
3. Provisions regarding account and membership registration, membership payments, and the use of User accounts;
4. Prohibitions, warranties, and limitations of liability; and
5. Other related matters.

1. DEFINITIONS

   1. “FIT HUB” may refer to the trademark, business unit, or club, all of which are owned by PT Jaya Digital Properti;
   2. “FIT HUB GO” may refer to the trademark, business unit, or club owned by PT Jaya Digital Properti that features different facilities from regular FIT HUB clubs and offers different types of memberships;
   3. “Website/Application” means the website and/or software application on Android and iOS created, operated, and provided by PT Jaya Digital Properti for purposes including but not limited to transactions related to membership, member operations when entering FIT HUB areas, and other matters associated with the use and fulfillment of services and actions relevant to FIT HUB operations;
   4. “User” means any user of the services, whether registered as a member or not (free trial, one day pass, and other forms);
   5. “Services” means all activities of the User in any form relating to the use of and access to the Website/Application, Gym, FIT HUB Clubs, FIT HUB GO, and our classes, whether membership-based or non-membership-based (free trial, one day pass, etc.), including but not limited to the use of equipment, facilities, programs, and other related matters;
   6. “Intellectual Property Rights” means all types of intellectual property rights including but not limited to: (i) patents, patent applications, patent disclosures, and patent inventions; (ii) Internet domain names, trademarks, service marks, trade dress, trade names, logos, and corporate names, together with all related goodwill; (iii) copyrights (registered or unregistered) and copyrightable works, together with registrations and applications; (iv) mask works and related registrations and applications; (v) computer software, data, databases, and related documentation; (vi) trade secrets and other confidential information (including ideas, formulas, compositions, inventions (whether patentable or unpatentable, and whether practiced or not), know-how, manufacturing and production processes and techniques, research and development information, drawings, specifications, designs, plans, proposals, technical data, and copyrighted works, financial and marketing plans, as well as customer and supplier lists and information); and (vii) copies and tangible embodiments thereof (in any form or medium).

2. SPECIFIC GENERAL TERMS

   1. Users represent and warrant that they are legally competent and not under guardianship or curatorship, and that they have the legal capacity and authority to bind themselves to these Terms and Conditions. If a User does not meet these requirements but continues to access or use the Website/Application, the services available on the Website/Application, offers within the Website/Application, or the applicable payment methods, the User represents and warrants that such access or activity has been approved by the User’s parent, guardian, or legal custodian. Users expressly waive any rights under applicable laws to revoke or cancel any and all consents granted under these Terms and Conditions at the time the User is deemed legally competent.
   2. Users are responsible for their accounts that contain personal information and for all activities carried out in connection with the use of such accounts on the Website/Application, and must ensure that all use of the Website/Application complies with these Terms and Conditions, the Terms and Conditions of Service Use, and the Privacy Policy, which together form a unified set of binding terms.
   3. Users bear full and absolute responsibility for safeguarding and protecting the confidentiality of their account information, including but not limited to username, password, and other information related to their account within the Website/Application.
   4. Users agree that, if necessary, FIT HUB may discontinue offers made to the User, and FIT HUB reserves the right at any time to modify or terminate any aspect or feature of the offers provided.
   5. FIT HUB reserves the right to deny access or usage of the Website/Application to Users at any time, with or without notice, due to actions deemed to violate these Terms and Conditions or for any other reason based on FIT HUB’s internal policies.
   6. FIT HUB reserves the right at any time to disclose any information regarding Users deemed necessary to comply with applicable laws in legal processes or at the request of authorities, or to modify, refuse to display, or delete any information or material, in whole or in part, in accordance with FIT HUB’s policies.

3. PERSONAL INFORMATION & ACCOUNT

   1. Before Users can utilize our Services—including but not limited to activities within the Website/Application, membership activities, free trial, one day pass, or other related programs requiring Users to be present in FIT HUB Club areas—Users are required to register an account first. During the account registration process, Users will be asked to provide their personal information, which may include:
      1. Identification (KTP/SIM/Passport);
      2. Phone number;
      3. Address;
      4. Email address;
      5. Personal data;
      6. Emergency contact number;
      7. A profile photo without any facial covering of any kind, including but not limited to masks, glasses, sunglasses, accessories, or hats, to ensure that the User’s face is clearly captured by the camera; and
      8. Other relevant personal information when required.
   2. Users understand and agree that 1 (one) phone number can only be used to register a maximum of 1 (one) User account, except for Users who previously had multiple accounts linked to the same phone number.
   3. FIT HUB will never request the User’s username, password, SMS verification code, or OTP code for any reason. Therefore, FIT HUB advises Users not to provide such information or any other important data to anyone claiming to represent FIT HUB or any party whose security cannot be guaranteed.
   4. Users agree to ensure that they log out of their account at the end of each session and notify FIT HUB if any unauthorized use of their password or account is detected.
   5. Users hereby acknowledge that FIT HUB is not responsible for any losses or issues arising from misuse of the User’s account caused by the User’s negligence, including but not limited to approving and/or granting account access to others, lending the account to others, accessing links provided by others, sharing or showing verification codes (OTP), passwords, or email to others, or any other negligence resulting in loss or issues on the User’s account.
   6. We will make every reasonable effort to maintain the confidentiality of the information provided by Users during the account registration process, in accordance with the provisions of the Privacy Policy, which forms an integral and inseparable part of these Terms and Conditions. However, Users understand that FIT HUB cannot be held liable for any information leaks caused by external factors or criminal acts by third parties who unlawfully access and obtain Users’ confidential information. FIT HUB will nonetheless make reasonable efforts to take corrective actions to mitigate the damage.
   7. By registering an account and providing data and information in connection therewith, Users hereby declare that:
      1. The User is the rightful owner of the personal data registered on the Website/Application;
      2. If proven otherwise, FIT HUB is not responsible for any losses arising from the User’s actions and reserves the full and absolute right to deactivate the User’s account.

4. MEMBERSHIP

   1. To use the Services provided by FIT HUB—including but not limited to Services accessed directly at FIT HUB Club locations—Users are required to have an account on the Website/Application, register for membership, and make payment according to the type of membership and Services the User wishes to obtain.
   2. Provisions regarding the minimum age requirement for obtaining membership, as well as detailed requirements, are further regulated in the FIT HUB Service Usage Terms and Conditions, which form an integral and inseparable part of these Terms and Conditions.
   3. By continuing to access the Website/Application, the User hereby guarantees to:
      1. Use the Services only for themselves and not transfer their account to any other party for accessing the Services; and
      2. Comply with the Service Usage Terms and Conditions and the Privacy Policy.
   4. If there are any changes to the User’s data, particularly personal information, the User is required to update the information immediately on the FIT HUB Application in order to continue using our Services.
   5. Users hereby agree to receive information regarding their membership status, promotions, and all events conducted by FIT HUB from time to time.
   6. Users understand and agree that if, for any reason, the User deletes their FIT HUB account—whether intentionally or unintentionally—the User’s membership will automatically be considered terminated, and the User will no longer be able to access any FIT HUB Services. Such deletion also terminates any remaining unused membership program, and the User will not be entitled to request any refund in any form except as specified in point 4(e) of the Service Terms and Conditions.
   7. Users understand that deleting the account will also affect their account history and payment records, and the User will no longer be able to access such information. Users further understand that the account cannot be reactivated for any reason once the account has been deleted.

5. USE OF WEBSITE/APPLICATION

   1. Users are permitted to use the Website/Application solely to access information related to facilities, Services, workout schedules, classes, and other Services that may be provided by us.
   2. Users are not allowed to use the FIT HUB Website/Application for any other purpose that is unlawful or harmful to others, including but not limited to harming us as the owner of the Website/Application and Services.
   3. Users hereby agree not to send, share, or upload content that is unlawful, contains violence, contains discrimination, or infringes upon the Intellectual Property Rights of others when using the FIT HUB Website/Application.
   4. Users agree not to use and/or access FIT HUB’s system, directly or indirectly, in whole or in part, using viruses, software, or other technologies that may weaken, damage, disrupt, hinder, restrict, and/or take over the functionality and integrity of software systems, hardware, networks, and/or data on the Website/Application.
   5. Users are prohibited from creating and/or using hardware/software/features and/or other tools, including but not limited to emulators, robots, macros, crawlers, and/or automated devices aimed at accessing or using the Services on the FIT HUB system, in ways that may harm FIT HUB, including but not limited to crawling/scraping activities, copying content, collecting or stealing User data, and/or other activities that can reasonably be considered manipulation of the Services and Website/Application.

6. PAYMENT

   1. The use of FIT HUB Services requires certain payments such as membership fees or additional charges for special services, including but not limited to the use of personal trainers to help Users optimize their experience with our Services.
   2. Users are responsible for paying all fees incurred to access and enjoy the Services provided, in accordance with these Terms and Conditions.
   3. Payments made by Users as mentioned above must be conducted solely through the payment methods available on the Website/Application and must be paid to our official account and/or virtual account. Users are advised not to make payments to any account other than FIT HUB’s official account or virtual account, including but not limited to accounts belonging to employees or any other account not registered under PT Jaya Digital Properti.
   4. Any losses arising from payments made outside the official FIT HUB accounts and in violation of these Terms and Conditions are not the responsibility of FIT HUB.
   5. Users must complete payment using the selected payment method and ensure that the payment amount matches the billing amount shown on the payment page. FIT HUB is not responsible for any losses incurred if Users make payments that do not match the billing amount displayed on the payment page.
   6. The fees referred to in this section include Service Tax, Goods Tax, Value Added Tax, and any other applicable taxes in accordance with prevailing laws and regulations.
   7. All payments made are non-refundable for any reason, except as specified in point 4(e) of the Service Terms and Conditions.

7. PROHIBITED ACTIVITIES
   FIT HUB prohibits Users from engaging in any of the following actions when using the Services:

   1. Actions that violate these Terms and Conditions, applicable laws and regulations, court decisions, legally binding orders or decrees, or administrative actions;
   2. Actions that may violate public order, decency, or cultural norms;
   3. Actions that infringe Intellectual Property Rights, such as copyrights, trademarks, and patents, as well as rights of publicity, privacy, and all other rights granted by law or contract with us and/or third parties;
   4. Posting or transmitting expressions involving excessive violence; expressions leading to discrimination based on race, nationality, religion, gender, social status, family background, etc.; expressions encouraging or inducing suicide, self-harm, or drug abuse; or expressions containing antisocial content that causes discomfort to others;
   5. Actions that benefit or involve cooperation with antisocial groups;
   6. Actions related to religious activities or solicitation to particular religious groups;
   7. Unauthorized or improper collection, disclosure, or provision of others’ personal information, registered information, user history, or similar data; and
   8. Actions that violate content regulations including pornography, unethical content, and similar prohibited material.

8. SUSPENSION, TERMINATION, AND CANCELLATION
   We reserve the right to: (i) refuse to complete or cancel processes related to User activities on the Website/Application; (ii) suspend, restrict, or terminate the User’s access to one or all of the Services; and/or (iii) immediately deactivate the User’s account for any reason, including but not limited to the following:

   1. We reasonably believe we are required to do so under applicable law, by any court, or by any authority with jurisdiction over us;
   2. We suspect that the User is acting in violation of these Terms and Conditions;
   3. The use of the User’s account is under litigation, investigation, or governmental review, and/or we identify a high risk of non-compliance with applicable laws or regulations related to the User’s account activities; and
   4. The User engages in any action that may circumvent our control, such as abusing promotions offered by us from time to time.

   
   We may suspend, restrict, or terminate the User’s access to one or all of our Services and/or deactivate or cancel the User’s account without providing a reason and with prior notice to the User. Users acknowledge that our decision to take action—including restricting access to the Website/Application, suspending, or closing the User’s account—may be based on confidential criteria essential to our risk management and security protocols. Users agree that we are under no obligation to disclose details of such risk management practices or security procedures.

9. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

   1. FIT HUB always strives to keep the Website/Application safe, convenient, and functioning properly, but we cannot guarantee continuous operation or perfect access to our Services.
   2. To the fullest extent permitted by applicable law, FIT HUB (including its parent company, directors, and employees) shall not be held liable—and Users agree not to hold FIT HUB liable—for any damages or losses (including but not limited to loss of money, reputation, profits, or other intangible losses) arising directly or indirectly from:
   3. The User’s use or inability to use FIT HUB Services;
   4. Delays or disruptions in FIT HUB Services;
   5. Losses arising from unauthorized payments made to parties other than FIT HUB’s official accounts, including any party falsely claiming to represent FIT HUB, negligence in entering bank account information, and/or bank-related errors;
   6. Viruses or other harmful software (bots, scripts, automation tools beyond the Power Shop feature, hacking tools) obtained by accessing or connecting a system to the Website/Application;
   7. Interferences, bugs, errors, or inaccuracies within FIT HUB Services;
   8. Damage to the User’s hardware arising from the use of any FIT HUB Service;
   9. Hacking actions performed by third parties on the User’s account.

10. INDEMNIFICATION
    Users shall release FIT HUB from claims for compensation and indemnify FIT HUB (including its parent company, directors, and employees) against any claims or demands, including reasonable legal fees, made by third parties arising from the User’s breach of these Terms and Conditions, improper use of FIT HUB Services, and/or the User’s violation of the law or third-party rights.

11. GOVERNING LAW
    This Agreement is governed by and construed in accordance with the laws of the Republic of Indonesia. Users agree that any legal action or dispute that may arise from or in any way relate to the Website/Application and/or this Agreement shall first be resolved amicably. If it cannot be resolved, the User agrees to submit to the jurisdiction of the South Jakarta District Court and/or any other District Court authorized to adjudicate legal disputes between the User and FIT HUB.

12. CHANGES TO THE TERMS AND CONDITIONS
    In the event of changes or additions to these Terms and Conditions, we will notify Users no later than 7 (seven) days prior to the effective date. Such notice may be given by email, in-app notifications, or other forms of notice at FIT HUB’s discretion.
